1. Acceptance of Terms

1.1  You agree to and are bound by, without modification, limitation or qualification, the terms and conditions set forth below and in any modified or additional terms that ACS (Independent) may publish from time to time (collectively, the “Terms”) for the use and access of the ACS Online Heritage Gallery (the “Gallery”). If you do not agree to all of the terms and conditions contained in the Terms of Use, do not access or use this Gallery.

1.2 ACS (Independent) may, at its sole discretion, modify or revise the Terms at any time without notice to you. Your continued access or use of the Gallery constitutes your acceptance of such changes. Your access and use of the Gallery will be subject to the current version of the Terms.

2. Intellectual Property

2.1 You hereby acknowledge and agree that the Gallery, its contents, and its arrangement are protected by copyright. You expressly agree and acknowledge that ACS (independent) owns all intellectual property including but not limited to copyright to the Gallery, and to all photographs, videos, or other media and works in the Gallery unless it is expressly stated in the Gallery that ACS (Independent) does not own the same.

2.2 Without limiting the foregoing, ACS (Independent) owns the trade marks, whether registered or unregistered, (collectively, the “Trade Marks”) displayed on the Gallery. Nothing contained in the Gallery should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any Trade Marks displayed on the Gallery without the express permission of ACS (Independent). Any unauthorised use of the Trade Mark is strictly prohibited.

3. Prohibition on Commercial Use

3.1 You expressly acknowledge that any and all commercial exploitation of any of the contents of the Gallery owned by ACS (Independent) is strictly prohibited without the express, written consent of ACS (Independent).

3.3 All requests for permission to produce protected materials for commercial use should be addressed directly to CORP_ADMIN@ACSINDEP.EDU.SG.

4. Links to Other Web Sites

4.1 You may provide hyperlinks to the Gallery or specific content contained in the Gallery from websites or social media sites in your control, however by doing so you expressly agree to not cast ACS (Independent) in a disparaging, false or misleading light.

5. General

5.1 If any of the Term is or becomes invalid or unenforceable, it shall be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant Term shall be deemed deleted.

5.2 Any modification to or deletion of a provision under this Term shall not affect the validity and enforceability of the rest of the Terms.

5.3 Any and all disputes arising out of these Terms shall be determined under the laws of Singapore and you submit to the exclusive jurisdiction of the Courts of Singapore.

5.4 Any questions regarding the foregoing Terms may be direct to CORP_ADMIN@ACSINDEP.EDU.SG .
